QDRO Compliance Services can testify in court on your client’s behalf regarding any QDRO issues that may arise.  But remember, because we write so extensively in the field of QDROs, we can never be a “hired-gun” in court and testify in a manner that contravenes our published opinions and well-established caselaw. Our testimony is tried and true, so for example, if the alternate payee was awarded a full property interest in the participant’s pension, don’t ask us to testify that the alternate payee should NOT be entitled to a pro-rata share of any early retirement subsidies or survivorship.

On the other hand, if the participant’s lawyer drafted a QDRO without adequate survivorship language that would be necessary to secure the alternate payee’s full pension rights and entitlements, call us right away, because survivorship is a necessary and inherent part of any properly drafted QDRO.
